Text Box: Friends and family alike routinely ask our office whether they should submit to a breath test if they are stopped for DWI by a police officer. The answer to this question depends largely on the individual facts of a given situation, so a uniform answer is not appropriate.

Text Box: When stopped by an officer for DWI, you have the right to not submit to a breath test or to field sobriety tests (walk-and-turn, one-leg-stand, etc.). Performing any of these tests is completely your choice. In most DWI stops, the officer has already made up his or her mind that a driver is intoxicated, so the tests are more a method to gather evidence than to allow a driver to go on his or her “merry way.”

A very critical point that many attorneys miss, and most of the public does not understand, is that one must file for an ALR Hearing within 15 days of the date of arrest, in order to keep their driving privileges. This applies whether the driver submitted to a breath test or not. 

If you have recently been arrested for and charged with DWI, it is of the utmost importance that you hire an attorney to not only handle the criminal charges pending against you, but also immediately file for an ALR Hearing in order to protect your driving privileges.

It is important that you do not panic at this point, although the urge to do so is very strong. DWI cases are complex and take a great deal of attention, but such cases are not insurmountable.
